Terms of Service
By placing an order through the website, your submission constitutes an offer to buy. Our acceptance of that order will be confirmed by an email.
Product Specifications and Suitability
We always strive to have our published product details, specifications and suitability information accurate and up to date. In the unlikely event that any information on the product shown on the Site is incorrect, we shall not be held responsible for the accuracy of any advice given regarding the suitability (or otherwise) of any product / part purchased. If you have ordered an item that has an unsuitable product description we will remedy this by providing you a full refund upon the return of the item.
We encourage you to ensure all bicycle products are fitted by a competent person in accordance with manufacturer specifications. We cannot be held liable for any damage caused by improper assembly or fitting. Some manufacturer guarantees may be on condition that you use a qualified cycle technician.
Payment over the Internet can be made via our secure check out pages using Visa, Mastercard and Paypal. Card.
We do our best to ensure prices stated on this website are accurate. When an error does occur (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated, and reserve the right to cancel your purchase.
All prices are quoted in New Zealand Dollars ($NZD) and include Goods and Services Tax (GST) at current New Zealand rates. Accordingly, international customers may find that the amount shown on their credit/debit card statement not to be the same as the amount which was indicated on our website due to currency fluctuations. This is not something within our control.
If goods ordered by you are subject to a tax, duty or other charge when the package reaches its destination, responsibility for paying those charges is yours, not ours. You assume the role of importer of the goods and we cannot be liable to you for any delay or failure of the goods to reach their delivery address due to detention of a package by customs or other authorities.
At ABC, we’re about giving our customers the pleasure and courage to ride their bikes everyday. That means ensuring that each and every customer gets the high quality reliable product they deserve. We stand by our products and will provide support to resolve any issues promptly and positively should they come up.
If you’re having an issue with your bike, we want to help resolve it. You may contact us directly. When contacting us please provide your original order information, a description of the issue and a photograph of the affected part so that we can resolve your issue as soon as possible.
Warranties apply only to the original owner of the product and is not transferable. If your item is faulty upon receipt or is not as described, we will gladly correct or exchange your purchase. All returns are subject to us being informed of the issue and receiving the item back within 30 days of receipt by the customer.* Items must be returned with their original packaging and, unless they were damaged prior to you receiving them, must still be in an undamaged, unused and saleable condition. Improper assembly or maintenance may void your warranty. Consumable components such as tyres, tubes, brake shoes and cables etc. are excluded from warranty. Shipping and labour charges are not included in this warranty. Surface rust is not included under warranty. Structural rust that may compromise the safety of the bike is included, however, if this has resulted from obvious neglect or mistreatment may void your warranty. Replacements will be made with frames of current design that may not be exact duplicates of originally purchased goods. The frame model used for replacement will not be lower in value than the original frame. This warranty gives you specific rights in addition to other rights you may have.
Our bikes meet or exceed all of the requirements of the relevant ANZ Standards and Consumer Product Safety Standards.
ABC will repair at their discretion any product found to be faulty within a reasonable time after you buy it.* If ABC are unable to repair the item we will replace the product or give you a refund. If your item is faulty upon receipt or is not as described, we will gladly repair or exchange your product. All returns are subject to us being informed of the issue and receiving the item back within 30 days of receipt by the customer. *A reasonable time frame or life of a product is the period, during which the item retains its original properties. The quality of a product gradually degrades in time, as a result of normal wear and tear. However, you may also accelerate this process of degradation by an improper use. A claim will not be recognised, if the defects were caused by your unprofessional interference or are the result of normal wear and tear.
Returns / Cancellations
ABC. will comply with its obligations under the Consumer Guarantees Act NZ (CGA) or any other applicable consumer protection legislation that cannot be excluded. Subject to any such applicable laws, refunds or replacement products or services will be given at the discretion of company management.
Use and Copyright
You agree that the content you access, view or download on this site remains the property of ABC. or its Licencors as defined by New Zealand and International Intellectual Property Laws, including but not limited to Copyright and Trademark laws. You agree not to modify, alter such content in any way, or make it available to any third parties without explicit consent from ABC.
Limitation of Liability
We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, products, economic or commercial loses and third parties claims. This warranty does not affect your statutory rights.
We will do our best to get all orders dispatched as quickly as possible. We have no liability to you for any delay with the delivery of products ordered. You have the right to cancel delayed orders and get a refund prior to the item being dispatched.
If any of these Terms & Conditions are determined to be illegal, invalid or otherwise unenforceable by law, to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms, and the remaining Terms & Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
The laws of New Zealand apply to these terms and conditions. Any dispute arising in relation to these terms and conditions will be resolved in accordance with New Zealand law.
